Terms of Service

These terms are the agreement between you and Ourday Labs LLC for the use of Ourday. They are written to be read, not to trip you up. Please read them. By creating an account or using Ourday, you agree to them.
Who we are
Ourday is operated by Ourday Labs LLC (“Ourday,” “we,” “us”), a limited liability company in Texas, United States. You can reach us anytime at hello@ourday.today.
What Ourday is
Ourday is a paid service that helps a household keep track of the things worth remembering. It works over text message and email. There is no app. You add things by texting or forwarding email, anyone in the household can ask what is coming up, and Ourday sends short briefings on a schedule along with reminders for what is ahead. Ourday is for organizing your own family. It is not a marketing service, and it does not send promotional content.
Who can use Ourday
You must be at least 18 years old to create and run an Ourday account. When you create an account, you are the account owner for your household. You confirm that the information you give us is accurate, that you have the authority to add the people you list, and that you will keep your account details up to date.
Your account and your household
As the account owner, you can add members of your household, up to the limit shown when you sign up. You are responsible for the people you add and for the numbers and addresses you provide for them. You agree that you have permission to add each member and to provide their mobile number for text messages where you choose to. You are responsible for activity that happens under your account, so keep your access secure and let us know if you think someone else has it.
For any member, you can choose that they receive no text messages. A member with no mobile number, or one you mark as no text messages, still takes part through email. You can change who receives text messages at any time by telling us.
Children and families
Ourday is built for households that include children, and we take that seriously. Only an adult account owner can set up an account and add household members. When you add a child, including a child under 13, you are providing consent for us to collect and use that child's information as part of the service, and you confirm you are that child's parent or legal guardian or are otherwise authorized to do so. How we handle information about children is described in our COPPA Disclosure and our Privacy Policy. Children do not create or run accounts themselves.
Subscription, billing, and cancellation
Ourday is a paid subscription. The price, the billing cycle, and any free trial are shown to you when you sign up, and you authorize us (through our payment processor) to charge the payment method you provide on a recurring basis until you cancel. Unless stated otherwise at signup, subscriptions renew automatically for the same period.
You can cancel at any time. When you cancel, your subscription stays active through the end of the period you have already paid for, and it does not renew after that. Payments already made are not refundable except where required by law. If we change the price, we will tell you in advance, and the new price applies to the next renewal after the notice.
Text messages
This section covers the Ourday text messaging program. If you provide a mobile number and agree to receive text messages, the following applies.
- Program. Ourday, your household's schedule briefings, reminders, and replies to messages you send in.
- Who receives messages. Only the members of a subscribing household whose mobile numbers were added by the account owner, and who were not marked as no text messages.
- Message frequency. Message frequency varies by household and by how you use Ourday.
- Cost. Message and data rates may apply, depending on your mobile plan. The text messaging itself is part of your Ourday subscription; there is no separate charge from us for it.
- Getting help. Reply HELP to a message, or email us at hello@ourday.today.
- Stopping messages. Reply STOP at any time to stop text messages to that number. You can also tell us in plain language and we will stop. Stopping text messages does not cancel your subscription on its own.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Consent to receive text messages is given by the account owner on behalf of the household and is not a requirement for using the rest of Ourday, which also works over email.
Using Ourday responsibly
Ourday is for organizing your own household. Please do not use it to break the law, to send messages to people who have not agreed to be added by you, to harass anyone, to send harmful or deceptive content, or to interfere with or try to break the service. We may suspend or limit use that does any of these things.
Your content
The things your family puts into Ourday, the events, tasks, notes, and everything else, belong to you. You give us the permission we need to store that content and operate the service for you, such as showing it back to your household, sending your briefings, and keeping your family's history. We do not sell your content, and we do not use individual family data to train third-party AI models. How long we keep your content, and how we handle deletion, is described in our Privacy Policy.
Our rights
Ourday itself, including the service, its software, and the Ourday name and brand, belongs to Ourday Labs LLC. These terms do not give you ownership of any of that. You may use Ourday only as these terms allow.
Privacy
Our Privacy Policy explains what we collect, how we use it, who we share it with, and the rights you have. By using Ourday you agree to that policy. For households with children, the COPPA Disclosure adds detail about information relating to children.
Availability and changes to the service
We work to keep Ourday running well, but we cannot promise it will always be available or error free. We may change, add, or remove features over time. If we plan a change that meaningfully reduces what you signed up for, we will aim to tell you in advance.
Disclaimers
Ourday is provided on an “as is” and “as available” basis. To the fullest extent allowed by law, we make no warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Ourday helps your family keep track of things, but you are responsible for your own decisions and for confirming anything important. We are not responsible for missed events, deadlines, or consequences that result from relying on the service.
Limitation of liability
To the fullest extent allowed by law, Ourday Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost data, or other losses that are not direct, arising out of or relating to your use of Ourday. To the fullest extent allowed by law, our total liability for any claim relating to Ourday will not exceed the amount you paid us for the service in the twelve months before the event that gave rise to the claim. Some places do not allow these limits, so parts of this section may not apply to you.
Indemnification
You agree to cover and hold us harmless from claims, losses, and reasonable costs that arise from your misuse of Ourday, your violation of these terms, or your violation of someone else's rights, including adding a person or a mobile number you were not authorized to add.
Ending your use
You can stop using Ourday and cancel at any time. We may suspend or end your access if you break these terms, if it is needed to protect the service or other people, or if we are required to by law. Sections that by their nature should continue after your use ends, such as the ones on your content, our rights, disclaimers, limitation of liability, and indemnification, will continue to apply.
Changes to these terms
We may update these terms from time to time. When we make a meaningful change, we will update the date at the top and, where appropriate, let you know. If you keep using Ourday after a change takes effect, that means you accept the updated terms.
Governing law and disputes
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules. If you have a concern, please reach out to us first at hello@ourday.today so we can try to resolve it directly. Any dispute that cannot be resolved that way will be handled in the state or federal courts located in Texas, and you and we agree to that jurisdiction, except where the law gives you the right to have it handled where you live.
